Enabling private subsets in subset editor

Is there a setting to enable users to create their own private subsets in the subset editor without ‘Edit Mode’?

In one of our environments, you do not need to be in ‘Edit Mode’ to be able to see that save button. However, in our production environment its disabled. I was having trouble finding how this functionality works after some digging.

In the new version of Apliqo the end user is able to create the private subset via subset editor

One of the environments must have been updated to new version and production still using old version.
